Informácia o spracúvaní osobných údajov hostí

Aké údaje spracúvame: meno a priezvisko, dátum narodenia, adresa trvalého pobytu, štátna príslušnosť, číslo občianskeho preukazu alebo cestovného dokladu, číslo víza ak sa vyžaduje, kontaktné údaje (e-mail, telefón), údaje o pobyte (dátumy, počet osôb, mená všetkých ubytovaných vrátane detí) a fotografia prednej strany dokladu totožnosti všetkých dospelých hostí.
Účely a právne základy:
Poskytnutie ubytovania a komunikácia s vami. Plnenie zmluvy, čl. 6 ods. 1 písm. b GDPR.
Vedenie knihy ubytovaných. Zákonná povinnosť podľa § 24 zákona č. 253/1998 Z. z., čl. 6 ods. 1 písm. c.
Hlásenie pobytu cudzincov cudzineckej polícii. Zákonná povinnosť podľa zákona č. 404/2011 Z. z. o pobyte cudzincov, čl. 6 ods. 1 písm. c.
Fotografia prednej strany dokladu totožnosti všetkých dospelých hostí. Slúži na overenie totožnosti a na získanie údajov, ktoré zo zákona zapisujeme do knihy ubytovaných a do hlásenia pobytu cudzincov. Plnenie zmluvy a zákonná povinnosť, čl. 6 ods. 1 písm. b a c.
Výber a evidencia mestskej dane. Zákonná povinnosť podľa VZN obce a zákona č. 582/2004 Z. z.
Účtovné a daňové doklady. Zákonná povinnosť podľa zákona o účtovníctve a zákona o DPH.
Príjemcovia: poskytovateľ rezervačného a komunikačného systému Guesty ako sprostredkovateľ; poskytovateľ nástroja na automatizované čítanie údajov z dokladov ako sprostredkovateľ Anthropic, PBC; náš účtovník; príslušná obec pri mestskej dani; cudzinecká polícia a orgány verejnej moci, ak to vyžaduje zákon.
Doba uchovávania: evidencia ubytovaných približne 5 rokov, účtovné doklady 10 rokov, fotografia dokladu sa vymaže krátko po skončení pobytu. Po uplynutí lehôt údaje vymažeme alebo anonymizujeme.
Vaše práva: prístup k údajom, oprava, výmaz, obmedzenie spracúvania, prenosnosť a právo namietať. Máte tiež právo podať sťažnosť na Úrad na ochranu osobných údajov SR.
Poskytnutie údajov je potrebné na uzatvorenie a plnenie zmluvy o ubytovaní a na splnenie našich zákonných povinností. Bez nich vám nevieme poskytnúť ubytovanie. Nevykonávame automatizované rozhodovanie ani profilovanie.
Information on the processing of guests' personal data
Controller: cream one s. r. o., company ID (IČO) 53876636, registered office Plynárenská 3D, 821 09 Bratislava - Ružinov, Slovakia, email info@staywell.sk. We operate accommodation under the StayWell brand.
Data we process: first and last name, date of birth, permanent address, nationality, identity card or travel document number, visa number where applicable, contact details (email, phone), stay details (dates, number of guests, names of all guests including children) and a photo of the front side of the identity document of every adult guest.
Purposes and legal bases:
Providing your accommodation and communicating with you. Performance of a contract, Art 6(1)(b) GDPR.
Keeping the guest register. Legal obligation under Section 24 of Act No. 253/1998 Coll., Art 6(1)(c).
Reporting the stay of foreign nationals to the Slovak foreign police. Legal obligation under Act No. 404/2011 Coll. on the residence of foreigners, Art 6(1)(c).
A photo of the front side of every adult guest's identity document. It is used to verify identity and to obtain the data we are required by law to enter into the guest register and the foreign residence report. Performance of a contract and legal obligation, Art 6(1)(b) and (c).
Collecting and recording the local city tax. Legal obligation under the municipal ordinance and Act No. 582/2004 Coll.
Accounting and tax records. Legal obligation under the Accounting Act and the VAT Act.
Recipients: Guesty, our reservation and communication system provider, acting as processor; the provider of the automated document data extraction tool, acting as processor Anthropic, PBC; our accountant; the Slovak foreign police; the relevant municipality for the city tax; and public authorities where required by law.
Retention: guest register about 5 years, accounting records 10 years, the document photo is deleted shortly after your stay ends. After these periods we erase or anonymise the data.
Your rights: access, rectification, erasure, restriction, data portability and the right to object. You also have the right to lodge a complaint with the Slovak Data Protection Authority.
Providing this data is required to conclude and perform the accommodation contract and to meet our legal duties. Without it we cannot host you. We do not carry out automated decision-making or profiling.

Welche Daten wir verarbeiten: Vor- und Nachname, Geburtsdatum, Adresse des ständigen Wohnsitzes, Staatsangehörigkeit, Nummer des Personalausweises oder Reisedokuments, Visumnummer sofern zutreffend, Kontaktdaten (E-Mail, Telefon), Aufenthaltsdaten (Daten, Anzahl der Gäste, Namen aller Gäste einschließlich Kinder) und ein Foto der Vorderseite des Ausweisdokuments jedes erwachsenen Gastes.
Zwecke und Rechtsgrundlagen:
Bereitstellung der Unterkunft und Kommunikation mit Ihnen. Vertragserfüllung, Art. 6 Abs. 1 lit. b DSGVO.
Führung des Gästebuchs. Gesetzliche Pflicht nach § 24 des Gesetzes Nr. 253/1998 Slg., Art. 6 Abs. 1 lit. c.
Meldung des Aufenthalts ausländischer Staatsangehöriger an die slowakische Ausländerpolizei. Gesetzliche Pflicht nach Gesetz Nr. 404/2011 Slg. über den Aufenthalt von Ausländern, Art. 6 Abs. 1 lit. c.
Ein Foto der Vorderseite des Ausweisdokuments jedes erwachsenen Gastes. Es dient der Identitätsprüfung und der Erhebung der Daten, die wir gesetzlich in das Gästebuch und die Aufenthaltsmeldung für Ausländer eintragen müssen. Vertragserfüllung und gesetzliche Pflicht, Art. 6 Abs. 1 lit. b und c.
Erhebung und Erfassung der örtlichen Kurtaxe. Gesetzliche Pflicht nach der Gemeindeverordnung und Gesetz Nr. 582/2004 Slg.
Buchhaltungs- und Steuerunterlagen. Gesetzliche Pflicht nach dem Rechnungslegungsgesetz und dem Umsatzsteuergesetz.
Empfänger: Guesty, unser Anbieter des Reservierungs- und Kommunikationssystems, als Auftragsverarbeiter; der Anbieter des Tools zur automatisierten Auslesung der Ausweisdaten, als Auftragsverarbeiter Anthropic, PBC; unser Buchhalter; die slowakische Ausländerpolizei; die zuständige Gemeinde für die Kurtaxe; sowie Behörden, soweit gesetzlich vorgeschrieben.
Aufbewahrung: Gästebuch etwa 5 Jahre, Buchhaltungsunterlagen 10 Jahre, das Ausweisfoto wird kurz nach Ende Ihres Aufenthalts gelöscht. Nach Ablauf dieser Fristen löschen oder anonymisieren wir die Daten.
Ihre Rechte: Auskunft, Berichtigung, Löschung, Einschränkung, Datenübertragbarkeit und Widerspruch. Sie haben außerdem das Recht, eine Beschwerde bei der slowakischen Datenschutzbehörde einzureichen.
Die Bereitstellung dieser Daten ist für den Abschluss und die Erfüllung des Beherbergungsvertrags und zur Erfüllung unserer gesetzlichen Pflichten erforderlich. Ohne diese Daten können wir Sie nicht beherbergen. Es findet keine automatisierte Entscheidungsfindung oder Profilbildung statt.
